El presente trabajo hace un análisis de los distintos usos que ha adoptado la memoria histórica en el Estado español desde la posguerra hasta la actualidad, diferenciando entre lo que denomina memoria como valor de cambio, propia del franquismo, y memoria como valor de uso, propia de la época que empieza desde finales de 1990 inicios de 2000, y cuyo texto de referencia es la vigente Ley 52/2007, de 26 de diciembre, de Memoria Histórica. El artículo hace un análisis crítico (...) del concepto de memoria que se desprende de la citada Ley y reivindica la necesidad de activar “otra” memoria útil para hacer frente a las actuales políticas de desmantelamiento de la democracia y los derechos. Luigi Ferrajoli no presenta su teoría del garantismo, únicamente, como un modelo normativo, sino también como un proyecto político. El objetivo de este artículo es realizar una crítica al constitucionalismo garantista como proyecto político, desarrollando algunas de las limitaciones y problemas que éste presenta para poder conformarse, por sí solo, en un proyecto válido para garantizar dignidad en las sociedades de las próximas décadas. Como señalaremos, en las sociedades de la segunda mitad del siglo XXI, este sólo puede ser un (...) programa político insuficiente por sí solo, si no se combina con otras corrientes como la del pluralismo jurídico y el autonomismo. Los últimos procesos constituyentes en los países andinos han supuesto el establecimiento de un modelo constitucional de fuerte contenido social y de plena (...) protección y justiciabilidad de los derechos sociales, que supera esta vieja tensión y, constituyen la manifestación de lo que, sin duda, podemos llamar un nuevo constitucionalismo de tercera generación. Being compassionate and empathic while making rational decisions is expected from healthcare workers across different contexts. But the daily challenges that these workers face, aggravated by the recent COVID-19 crisis, can give rise to compassion and decision fatigue, which affects not only their ability to meet these expectations but has a significant negative impact on their wellbeing. Hence, it is vital to identify factors associated to their exhaustion. Here, we sought to describe levels of compassion and decision fatigue during the (...) pandemic, and to identify factors related to these forms of exhaustion. We collected data using self-reported questionnaires to measure compassion fatigue, decision fatigue, and grit in five intervals from April to November, 2020 (N = 856). Our results showed a negative correlation between grit and compassion and decision fatigue. We also found that under the circumstances studied grit tends to be higher in technicians, nurses, other professionals (psychologists, social workers), and workers at the Emergency Room (ER), and lower in general practitioners. Compassion fatigue tend to be higher for technicians, whereas decision fatigue was lower for specialists, general practitioners, and technicians, and higher for those working at private hospitals. PURPOSE: There is an increasing demand for researchers to provide research results to participants. Our aim was to define an appropriate process for this, based on needs and attitudes of participants. METHODS: A multicenter survey in five sites in the United States and Canada was offered to parents of children with cancer and adolescents with cancer. Respondents indicated their preferred mode of communication of research results with respect to implications; timing, provider, and content of the results; reasons for and against (...) providing results; and barriers to providing results. RESULTS: Four hundred nine parents (including 19 of deceased children) and 86 adolescents responded. Most parents (n = 385; 94.2%) felt that they had a strong right to research results. For positive results, most wanted a letter or e-mail summary (n = 238; 58.2%) or a phone call followed by a letter (n = 100; 24.4%). If the results were negative, phone call (n = 136; 33.3%) or personal visits (n = 150; 36.7%) were preferred. Parents wanted the summary to include long-term sequelae and suggestions for participants (n = 341; 83.4%), effect on future treatments (n = 341; 83.4%), and subsequent research steps (n = 284; 69.5%). Understanding the researcher was a main concern about receiving results (n = 145; 35.5%). Parents felt that results provide information to support quality of life (n = 315; 77%) and raise public awareness of research (n = 282; 68.9%). Adolescents identified similar preferences. CONCLUSION: Parents of children with cancer and adolescents with cancer feel strongly that they have a right to be offered research results and have specific preferences of how and what information should be communicated. PURPOSE: The offer to return research results to participants is increasingly recognized as an ethical obligation, although few researchers routinely return results. We examined the needs and attitudes of parents of children with cancer and of adolescents with cancer to the return of research results. METHODS: Seven experts in research ethics scored content validity on parent and adolescent questionnaires previously developed through focus group and phone interviews. The questionnaires were revised and provided to 30 parents and 10 adolescents in a (...) tertiary care oncology setting. RESULTS: The content validity index for individual questions and the overall questionnaires scored as 0.86 for both questionnaires. All 30 parents and 10 adolescents who agreed to participate returned questionnaires. The majority (>95%) indicated that they had a strong or very strong right to receive results. Letter or e-mail was a satisfactory means to return results described as good or neutral (66% parents, 100% adolescents) but more participants wished face-to-face disclosure of results with negative implications (50% parents, 60% adolescents). Very few wanted results disseminated through a Web site. The majority acknowledged the need for peer-review before disclosure (60% of adolescents and parents) but did not want "to be the last to know." CONCLUSIONS: Our data suggest that pediatric oncology patients and parents of children with cancer strongly feel that they have a right to research results, and that they wish to receive these in a timely manner. Background: Low rates of participation of adolescents and young adults (AYAs) in clinical oncology trials may contribute to poorer outcomes. Factors that influence the decision of AYAs to participate in health research and whether these factors are different from those that affect the participation of parents of children with cancer. Methods: This is a secondary analysis of data from validated questionnaires provided to adolescents (>12 years old) diagnosed with cancer and parents of children with cancer at 3 sites in Canada (...) (Halifax, Vancouver, and Montreal) and 2 in the United States (Atlanta, GA, and Memphis, TN). Respondents reported their own research participation and cited factors that would influence their own decision to participate in, or to provide parental authorization for their child to participate in health research. Results: Completed questionnaire rates for AYAs and parents were 86 (46.5%) of 185 and 409 (65.2%) of 627, respectively. AYAs (n = 86 [67%]) and parents (n = 409 [85%]) cited that they would participate in research because it would help others. AYAs perceived pressure by their family and friends (16%) and their physician (19%). Having too much to think about at the time of accrual was an impediment to both groups (36% AYAs and 47% parents). The main deterrent for AYAs was that research would take up too much time (45%). Nonwhite parents (7 of 56 [12.5%]) were more apt to decline than white parents (12 of 32 [3.7%]; P < .01). Conclusions: AYAs identified time commitment and having too much to think about as significant impediments to research participation. Addressing these barriers by minimizing time requirements and further supporting decision-making may improve informed consent and impact on enrollment in trials. (shrink)

The major divide in contemporary epistemology is between those who embrace and those who reject a priori knowledge. Albert Casullo provides a systematic treatment of the primary epistemological issues associated with the controversy. By freeing the a priori from traditional assumptions about the nature of knowledge and justification, he offers a novel approach to resolving these issues which assigns a prominent role to empirical evidence. Charles Sanders Peirce is generally regarded as the founder of pragmatism, and one of the greatest ever American philosophers. Peirce is also widely known for his work on truth, his foundational work in mathematical logic, and an influential theory of signs, or semiotics. Albert Atkin introduces the full spectrum of Peirce’s thought for those coming to his work for the first time. This paper challenges the traditional assumption that descriptive and prescriptive sciences are essentially distinct by presenting a study on the implicit normativity of the production and presentation of biomedical scientific facts within evidence-based medicine. This interdisciplinary study serves as an illustration of the potential worth of the concept of implicit normativity for bioethics in general and for integrated empirical ethics research in particular. It demonstrates how both the production and presentation of scientific information in an evidence-based decision-support contain implicit presuppositions (...) and values, which pre-structure the moral environment of the clinical process of decision-making. As a consequence, the evidence-based decision support did not only support the clinical decision-making process; it also transformed it in a morally significant way. This phenomenon undermines the assumption within much of the literature on patient autonomy that information disclosure is a conditional requirement before patient autonomy even starts; patient autonomy is already influenced during the production and presentation of information. These results imply an increased responsibility of those who produce and present evidence-based facts(i.e. scientists in general and physicians in particular). The insights of this study not only involve a different focus on both theory and practice of patient autonomy and informed consent, but they also call for a broader scope of morality than does traditional empirical research in bioethics. The concept of implicit normativity within integrated empirical ethics research calls for a strong cooperation between bioethicists and descriptive scientists, i.e., a cooperation that goes beyond the discipline-specific epistemic values and that takes place during all phases of the research process. In the sixteen essays collected here, which span this entire period, philosopher Albert Casullo documents the complex set of issues motivating the renewed interest, identifies the central epistemological questions, and provides the leading ideas of a unified response to them.

Economics as a science of human behavior has been grounded in a remarkably parsimonious postulate: that of the self-interested, isolated individual who chooses freely and rationally between alternative courses of action after computing their prospective costs and benefits. In recent decades, a group of economists has shown considerable industry and ingenuity in applying this way of interpreting the social world to a series of ostensibly noneconomic phenomena, from crime to the family, and from collective action to democracy. The “economic” or (...) “rational-actor” approach has yielded some important insights, but its onward sweep has also revealed some of its intrinsic weaknesses. As a result, it has become possible to mount a critique which, ironically, can be carried all the way back to the heartland of the would-be conquering discipline. That the economic approach presents us with too simpleminded an account of even such fundamental economic processes as consumption and production is the basic thesis of the present paper. (shrink)

The American Institute of certified public accountants (AICPA) has promulgated a Code of Professional Conduct , which has served as the primary ethical standard for public accountants in the United States for more than 20 years. It is now out of date and needs to be replaced with a code of ethics. Just as U.S. generally accepted accounting principles are being migrated toward “principles-based accounting” as part of a convergence with international financial reporting standards, a similar process needs to occur (...) with ethics. This article organizes the primary rules of the AICPA Code around five essential virtues: objectivity, integrity, inquisitiveness, loyalty, and trustworthiness. These virtues correspond to the general principles set forth in the Code of Ethics for Professional Accountants of the International Federation of Accountants (IFAC). From this virtue ethics perspective, various rules of the AICPA Code are critiqued as being inadequate at best, and poorly crafted at worst. The article concludes with the proposition that principles-based ethics serves the profession and the financial reporting process better than the current rules-based approach. (shrink)

La investigación en su contexto más amplio -en cuya base se encuentra la _filosofía política de la educación nuestroamericana_- se propone propiciar un (...) diálogo participativo y reflexivo que sumerja la discusión actual en educación y política en una categoría como la esclavitud social y escolar, siempre con el imperativo de pensar _desde_ y _para _Latinoamérica. El artículo examina el conflicto formal que se produce en la descripción de Odradek al interior de “La preocupación del padre de familia” de Franz Kafka. En la voz de su narrador, Kafka se vale de un lenguaje de extraordinaria precisión para describir a su criatura (Odradek), produciendo una serie de paradojas. Prestamos atención seria a estas paradojas, mostrando las consecuencias que ellas plantean para los conceptos de “historia” en Kant y Benjamin, en sus respectivas relaciones con el concepto de (...) “naturaleza” en estos autores. According to Pablo Oyarzun, Benjamin’s concept of history “is not about a war over the representation of history, but a war over history itself. Only in so far as this is its field, there can also be a struggle for its representation”. While Oyarzun’s observation refers to the first “thesis” of Benjamin’s «On the Concept of history», in this article I argue that it can be productively used to shed light onto a broader understanding of the Benjamin’s concept of history. (...) To that end, I elaborate on Oyarzun’s comment in order to analyze and to render explicit the relationship between 'Truth' and 'presentation' in Benjamin’s thought. In doing so, I highlight the relevance of this relationship for the concept of 'History' that Benjamin elaborated in the late ‘30s. (shrink)

Leibniz was writing his "Discourse on the Natural Theology of the Chinese" as the Leibniz-Clarke Controversy developed. Both were terminated by his death. These two fronts show interesting doctrinal correlations. The first is Leibniz' concern for the "decadence of natural religion." The dispute with Clarke began with it, and the Discourse is a defense of Chinese natural religion in order to show its agreement with Christian natural religion. The Controversy can be summed up as "clockmaker God versus idle God." Leibniz (...) wants to escape from the perverse consequences that all criticism of divine voluntarism seems to cause. Thus, his elaboration is directed at a distinct concept of a God that rules without interposing, a supramundane intelligence. And the Leibnizian interpretation of the natural theology of the Chinese can be viewed the same way: it emphasizes a First Principle, Li, which rules without interposing. (shrink)

Albert Musschenga | : The central question of this article is, Are animals morally responsible for what they do? Answering this question requires a careful, step-by-step argument. In sections 1 and 2, I explain what morality is, and that having a morality means following moral rules or norms. In sections 3 and 4, I argue that some animals show not just regularities in their social behaviour, but can be rightly said to follow social norms. But are the norms they (...) follow also moral norms? In section 5, I contend, referring to the work of Shaun Nichols, that the basic moral competences or capacities are already present in nonhuman primates. Following moral rules or norms is more than just acting in accordance to these norms; it requires being motivated by moral rules. I explain, in section 6, referring to Mark Rowlands, that being capable of moral motivation does not require agency; being a moral subject is sufficient. Contrary to moral agents, moral subjects are not responsible for their behaviour. Stating that there are important similarities between animal moral behaviour and human, unconscious, automatic, habitual behaviour, I examine in section 7 whether humans are responsible for their habitual moral behaviour, and if they are, what then the grounds are for denying that moral animals are responsible for their behaviour. The answer is that humans are responsible for their habitual behaviour if they have the capacity for deliberate intervention. Although animals are capable of intervention in their habitual behaviour, they are not capable of deliberate intervention. | : La question centrale dans cet article est celle de savoir si les animaux sont moralement responsables de ce qu’ils font. Répondre à cette question nécessite une argumentation minutieuse et progressive. Affirmant qu’il y a de grandes similitudes entre le comportement moral d’un animal et le comportement inconscient, automatique et habituel d’un humain, je me penche, dans la section 7, sur la question de savoir si les humains sont responsables de leur comportement moral habituel, et si tel est le cas, sur quelle base on peut alors nier le fait que les animaux sont eux aussi responsables de leur comportement. La réponse à cette question est que les humains sont responsables de leur comportement habituel s’ils disposent d’une capacité d’intervention réfléchie, délibérée. There are two discourses that are used in connection with the provision of good healthcare: a rights discourse and a beneficial design discourse. Although the logical force of these two discourses overlaps, they have distinct and incompatible implications for practical reasoning about health policy. The language of rights can be interpreted as the ground of a well-designed healthcare system stressing the values of equality and inclusion, but it has less application when dealing with questions of cost-effectiveness. This difference reflects the (...) distinction between the deontological status of rights claims and a teleological approach presupposed in the language of beneficial design. However, the value of the separateness of persons contained in the discourse of rights can impose constraints on the adoption of a simple maximizing principle when thinking about the allocation of healthcare resources within a social contract for health. Throughout these issues are discussed by reference to the work of Peter Jones. (shrink)

Modern Social Contract Theory provides an exposition and evaluation of major work in social contract theory from 1950 to the present. It locates the central themes of that theory in the intellectual legacy of utilitarianism, particularly the problems of defining principles of justice and of showing the grounds of moral obligation. It demonstrates how theorists responded in a novel way to the dilemmas articulated in utilitarianism, developing in their different approaches a constructivist method in ethics, a method that aimed to (...) vindicate a liberal, democratic and just political order. A distinctive feature of the book is its comparative approach. By placing the works of Barry, Buchanan and Tullock, Harsanyi, Gauthier, Grice, Rawls, and Scanlon alongside one another, similarities and differences are brought out, most notably in the way in which principles are derived by each author from the contractual construction as well as the extent to which the obligation to adopt those principles can be rationally grounded. Each theory is placed in its particular intellectual context. Special attention is paid to the contrasting theories of rationality adopted by the different authors, whether that be utility theory or a deliberative conception of rationality, with the intention of assessing how far the principles advanced can be justified by reference to the hypothetical choices of rational contracting agents. The book concludes with a discussion of some principal objections to the enterprise of contract theory, and offers its own programme for the future of that theory taking the form of the empirical method. Para esto se esclarecen las posiciones éticas y políticas tempranas de su filosofía, la atingencia de la crítica de Horacio Cerutti, la estructura de la ética madura, el debate con Karl-Otto Apel, (...) la estructura de la política de la liberación y la crítica de Santiago Castro-Gómez. Fortunately, there have been several notable attempts. Throughout his works, Richard Shusterman frequently incorporates the perspectives of various East Asian philosophies into his articulation of somaesthetics. Multiple scholars have explored John Dewey’s lectures in China and their political and educational impact, such as Jessica Ching-Sze Wang’s John Dewey in China or The Democracy of the Dead by Roger T. Ames and David L. Hall. Still others have highlighted the influence of Indian thought on pragmatism’s forerunners, such as American Philosophy Before Pragmatism (Goodman 2015), American Pragmatism: An Introduction (Spencer 2020), and The Ethics of Oneness (Engles 2021). Perhaps the most interesting inquiries into this influence can be found in a special volume of The Journal of Aesthetic Education (Vol. 43, No. 1) where multiple scholars discuss pragmatism’s connections and comparisons to The Bhagavad Gita, Confucianism, and Taoism. Among these scholars is Scott Stroud whose most recent publication The Evolution of Pragmatism in India (2023) represents the culmination of nearly two decades of research on the subject with special attention to the continuities between pragmatism and Indian thought. In it, he meticulously explores the influence of John Dewey on one of his students, Bhimrao Ambedkar (1891–1956), who was a transformative figure in the founding of the nascent Republic of India. The result is a work of scholarship that shows the global relevance of pragmatism in the 20th Century, [End Page 456] introduces the fascinating philosophy of Ambedkar to a non-Indian audience, and provides an entry for further scholarship on this profound thinker and activist.Bhimrao Ambedkar was a critical figure in the birth of modern India. Born an “untouchable” due to the rigid caste system, he tirelessly advocated for the right of Dalits (“crushed” or “untouchables”). By the mid-20th century, he had greatly influenced Indian politics, safeguarded the interests of the oppressed, and played a key role in drafting the Indian Constitution. Separate to his role as a statesman, Ambedkar promoted Buddhism in the 1950s as an escape from caste oppression, culminating in his publication, The Buddha and His Dhamma (1957). While his name is less familiar outside of India, he was voted the “Greatest Indian” in a 2012 poll due to his profound impact on the nation’s post-independence development. These accomplishments were supported by an extensive education, but unlike most subjects of the British Empire, Ambedkar also studied in the United States. Stroud initiates his study by focusing on this formative period, specifically his time at Columbia University and the influence of the philosopher and psychologist John Dewey. While their relationship has been acknowledged, Stroud is the first to explore this relationship in depth and he not only reconstructs the influence of Dewey on Ambedkar’s Navayana Pragmatism but illuminates the ways that Ambedkar integrated, modified, and even resisted Dewey’s pragmatism.Stroud masterfully builds his reconstruction of this synergy between Dewey’s pragmatism and Ambedkar’s philosophy not out of ephemeral conjecture or pithy textual evidence, but through painstaking, detailed, and exhaustive scholarship. He draws on comparative evidence in their major and minor works, their private correspondence, interviews of Ambedekar’s cohort at Columbia, Dewey’s voluminous lecture notes, and even the marginalia and notecards found between the pages of Ambedkar’s pragmatism bookshelf. La presente investigación tiene como objetivo demostrar la relación de la mejora del rendimiento académico y dominio de tres competencias digitales: manejo de información digital y comunicación en el entorno digital, colaboración y, creación del contenido digital al ser usados por el estudiante universitario en su proceso de aprendizaje activo, cómo codifican la información que aprenden, cómo comunican su desarrollo y cómo crean sus conocimientos para cumplir un propósito de mejora en sus notas y mejora académica.

An edition of two manuscript essays found in the family archives of the descendants of the painter and writer Eugène Fromentin. These unpublished essays were submitted in 1840 by their author, Albert Aubert, to Fromentin and his friend Paul Bataillard, for comment and in part response to a question which they had posed, concerning the importance of ambition as a prerequisite for happiness. Les deux essais, publiés ici pour la première fois, datent de mars 1840. Leur auteur, Albert (...) Aubert, y répond, au moins partiellement, à une question que ses amis, Eugène Fromentin et Paul Bataillard, lui avaient posée : pour être heureux, l'homme doit-il avoir de l'ambition? Aubert passe en revue l'évolution de l'humanité, du spiritualisme métaphysique au spiritualisme laïc, et nous donne un témoignage sur l'histoire des mentalités sous la monarchie de Juillet : à l'individualisme et au libéralisme de 1789 a succédé la réhabilitation de l'intervention de l'État, afin de développer la solidarité au sein de la société. Ce débat évoque des questions qui sont d'une brûlante actualité, à une époque où nous éprouvons les limites du modèle démocratique, la crise de l'État-providence, l'essoufflement du modèle social-démocrate et la baisse d'efficacité des thérapeutiques keynésiennes. Englert et al. claim that, in certain circumstances, the Bohmian trajectory of a test particle does not match the reports of which-path detectors, concluding that the Bohmian trajectories are not real, but “surrealistic.” However, Hiley and Callaghan argue that, if Bohm’s interpretation is correctly applied, no such mismatch is ever sanctioned. Unfortunately, the debate was never settled since nobody showed where the source of disagreement resided. In this paper, I reassess the debate over such “surrealistic” trajectories and I derive both (...) a necessary and a sufficient condition for there to be a mismatch between the Bohmian trajectories and the reports of which-path detectors. I conclude that the mismatch is possible as a matter of principle, but can be ruled out in practice. I explore in depth the philosophical consequences of such mismatch arguing that it does not render realism about the Bohmian trajectories untenable. In addition, I show that the opposing conclusion of Hiley and Callaghan is due to the fact that they assume a set of trajectories that are incompatible with the postulates of Bohmian mechanics. El objetivo de este texto es investigar sobre los posibles puntos de encuentro entre la psicoterapia existencial, un paradigma psicológico arraigado en las filosofías de la existencia, y el posicionamiento del profesor Marino Pérez Álvarez, quien se define a sí mismo como conductista radical, respecto a su manera de entender la existencia humana y el modelo más adecuado de psicoterapia. Para ello se proponen seis puntos de encuentro: necesidad de una fundamentación filosófica para la psicología, crítica al cientificismo y al (...) modelo médico, interpretación de los trastornos mentales como problemas de la vida cotidiana, recuperación del paciente como protagonista de la terapia, crítica a la psicología positiva y crítica al dualismo cartesiano.
